ROAD CONTRACTOR WINS SUPREME COURT CASE
Wauchope company Mid Coast Road Services has won its long-running legal battle with Port Macquarie-Hastings Council.
The dispute stemmed from asphalt works undertaken on Ocean Drive in 2012 – which failed numerous times, resulting in the termination of the company’s contract.
But the Supreme Court has ruled Mid Coast Road Services was not at fault.
“Council will know now that the specifications which are attempting to apply were incorrect, and we’re hopeful that ratepayers’ money will be better spent, rather than litigating in the Supreme Court, fixing the state of the current roads,” Somerville Legal’s Adam Cutri said.
Council says it’s currently reviewing the ruling, and awaiting further advice from its lawyers.
