Criminal proceedings will begin in the Sydney District Court later this month against Drayton Family Wines over the 2008 explosion which killed winemaker Trevor Drayton and boiler maker Eddie Orgo.
WorkCover New South Wales launched the action – it has been investigating whether the business was in breach of workplace health and safety laws.
The 2011 inquest into the incident recommended no charges be laid.
